Article 1 – Definitions
Within these General Terms and Conditions, the following terms are defined as follows:
Withdrawal period:
The timeframe during which the consumer is entitled to exercise the right to withdraw from the agreement.
Consumer:
A natural person acting for purposes outside their trade, business, or profession who enters into a distance agreement with the entrepreneur.
Day:
A calendar day.
Ongoing transaction:
A distance agreement relating to a series of products and/or services where delivery or purchase obligations are spread over a period of time.
Durable medium:
Any tool that enables information addressed personally to the consumer or entrepreneur to be stored in a way that allows future access and unchanged reproduction.
Right of withdrawal:
The consumer’s right to cancel the distance agreement within the designated withdrawal period.
Entrepreneur:
The natural or legal entity offering products and/or services to consumers through distance selling.
Distance agreement:
An agreement concluded through an organized distance-selling system, whereby only remote communication methods are used up to and including contract formation.
Means of distance communication:
Any method used to conclude a contract without the physical presence of both parties at the same location.

The present General Terms and Conditions of the entrepreneur.

Article 3 – Scope of Application
These General Terms and Conditions apply to all offers made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.
Before entering into a distance agreement, the consumer will be provided with access to these General Terms and Conditions. If this is not reasonably possible, the entrepreneur will indicate how the terms can be accessed electronically and will provide them free of charge upon request.
Where additional conditions apply to specific products or services, the consumer may always rely on the provision most favorable to them in the event of conflicting terms.
If any clause within these General Terms and Conditions is declared invalid or annulled, the remaining provisions shall continue to apply. The invalid clause will be replaced by a mutually agreed provision that most closely reflects the original intent.
Article 4 – The Offer
Offers with a limited validity period or subject to specific conditions will be clearly stated.
All offers are without obligation. The entrepreneur reserves the right to modify or withdraw an offer at any time.
Each offer includes a clear and accurate description of the products and/or services provided. Images used are intended to represent the products faithfully; however, minor color variations may occur.
Each offer will clearly state:

The price, excluding import duties and VAT

Any applicable shipping charges

How the agreement is concluded

Whether the right of withdrawal applies

Available payment, delivery, and execution methods

The period during which the offer remains valid

Any conditions applicable to ongoing transactions
Article 5 – Formation of the Agreement
The agreement becomes effective once the consumer accepts the offer and fulfills all stated conditions. If acceptance is confirmed electronically by the entrepreneur, the consumer may cancel the agreement until such confirmation is received.
Article 6 – Right of Withdrawal
Consumers may return non-sale items within 30 days of receipt without stating a reason. Returned products must be unused, in their original condition, and in the original packaging.
Products purchased during Final Sale promotions with discounts of 40% or more are excluded from returns. This exclusion will always be clearly communicated at the time of purchase.
Article 7 – Costs Upon Withdrawal
If the right of withdrawal is exercised, the consumer is responsible for the return shipping costs to the supplier located in China.
Upon receipt of the returned item or valid proof of shipment, the entrepreneur will refund all amounts paid, including initial shipping costs, within 14 days.
Article 8 – Withdrawal Exclusions
The right of withdrawal does not apply to:

Products excluded for hygiene reasons, such as earrings or lingerie

Items purchased during Final Sale promotions (40% discount or higher)
Article 9 – Pricing
Prices stated in the offer will remain unchanged during the offer period, unless adjustments are required by law.
Article 10 – Conformity and Warranty
The entrepreneur ensures that all products and services comply with the agreement and meet reasonable standards of quality, usability, and reliability.
Article 11 – Delivery and Fulfillment
Orders are processed and fulfilled with due care.
If delivery is delayed, the consumer will be informed as soon as reasonably possible.
Article 12 – Payments
Unless explicitly agreed otherwise, full payment is required at the time of purchase.
All transactions made through Susan & Diane Portland are governed by these Terms of Service, which define pricing, payment procedures, and delivery conditions. The entrepreneur reserves the right to correct errors related to pricing, product descriptions, or availability without prior notice.

Article 14 – Governing Law
Susan & Diane Portland is operated by a company registered in the Netherlands. All agreements between the entrepreneur and the consumer are governed by Dutch law.
These Terms are subject to Dutch law unless mandatory consumer protection regulations in the customer’s country of residence provide otherwise. Statutory rights under European or Dutch consumer law remain fully unaffected.
Article 15 – Amendments
The entrepreneur may revise these General Terms and Conditions. Any changes will be communicated at least 30 days before taking effect.
Article 16 – Shipping and Return Locations
Susan & Diane Portland works with third-party logistics providers located in China. Orders are therefore shipped from China.
For this reason, approved returns must also be sent back to China. The applicable return address and instructions will be provided once the return request has been approved.

Article 17 – Legal Disclaimer
The return and exchange policy may be modified at any time without prior notice. Susan & Diane Portland retains the right to make the final determination regarding any return or exchange request.
Nothing in these Terms limits or excludes rights granted under applicable consumer protection legislation. Statutory rights remain intact and may vary depending on the consumer’s country of residence.
Winter Sale:
Our winter sale is valid until February 28, 2026. After this date, all sale conditions and availability may change or expire automatically.
